Terms of Service

These Terms govern your use of The ThriveOS website and application, including the free Performance Scan, personal dashboard, development resources, Thrive Guide and any paid services that are later activated. By creating an account or using the service after being presented with these Terms, you agree to the published Terms and the associated Privacy Policy.

If you do not agree, do not use the service.

You must be at least 18 years old and able to form a binding contract to use ThriveOS. You are responsible for accurate account information and for keeping your login credentials secure. Contact us promptly if you suspect unauthorized access to your account.

ThriveOS provides personal development tools, self-reflection exercises, goal planning, habit tracking, performance-related self-assessment, progress records and optional AI-generated assistance. The free dashboard may be used without purchasing The Blueprint, subject to applicable access, fair-use and security policies. The Guide and related AI services have published usage and rate limits and can be paused when necessary to protect service reliability and costs.

Features may evolve, and preview or beta functionality may change or be unavailable. We will describe material paid entitlements at checkout if and when paid sales are enabled.

ThriveOS content and Scan results are for education, reflection and general self-development. They are not medical, psychological, psychiatric, financial, legal, employment or other professional advice. The Scan is self-reported and has not been represented as an independently validated diagnostic or a predictor of job performance. Do not use it as a substitute for a qualified professional or an emergency service.

We do not guarantee a promotion, weight change, earnings, relationship result, business outcome, increased productivity or any other personal result.

Thrive Guide is an automated AI system. AI-generated responses can be wrong, outdated or unsuitable for your circumstances. You are responsible for reviewing suggestions and deciding how to act on them. The Guide cannot make binding decisions, diagnose conditions or provide emergency support. Usage limits, availability and access vary by entitlement. Additional disclosures are provided in the AI Coaching and Scan Notice.

You retain whatever rights you otherwise hold in the information you submit, such as your own goals, notes and reflections. You authorize us and our service providers to process that information as reasonably necessary to operate the service as described in our Privacy Policy. You represent that you have the rights needed to provide material you submit and will not include confidential third-party information without authorization.

Any broader content license (for example, to use member submissions to train models or to publish testimonials) requires a separate, accurately described consent or legal basis; these Terms do not grant it by implication.

Do not use ThriveOS to break the law, harass others, compromise accounts or security, automate abusive requests, evade AI quotas through duplicate accounts or scripts, distribute malicious content, or attempt to access another member's private information. We may restrict access to prevent material misuse, with appropriate account notices and remedies consistent with law.

The ThriveOS name, original lessons, software interfaces, frameworks, text and other materials may be protected by applicable intellectual-property laws and third-party rights. Except for access granted through your plan, no transfer of ownership or broad redistribution license is given. Any claims of registered marks or exclusive ownership require independent verification.

The free ThriveOS experience does not require a credit card. The Blueprint is available as a one-time purchase, with the price, included content and refund policy shown before you pay. Paid purchases are governed by our Paid Services, Billing & Refunds terms.

You may stop using the service and request account deletion through the verified process explained in the Privacy Policy. We may suspend access for security, abuse or legal reasons or discontinue a feature where permitted. We will not imply that account deletion or data export is immediately self-service unless the feature actually exists.

Certain features rely on third-party hosting, identity, AI or email systems. Their services may have independent terms and policies. We are not responsible for third-party content outside our control to the extent the law permits.

We may update our service and these Terms. The published Terms will show an effective date and provide advance or contemporaneous notice where legally required. We aim to provide a reliable service but do not promise uninterrupted availability.

Disclaimer of warranties. To the fullest extent permitted by law, ThriveOS is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability. To the fullest extent permitted by law, The Skillful Company will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of ThriveOS. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Some jurisdictions do not allow these limits, so they may not apply to you.

Indemnity. You agree to indemnify The Skillful Company against third-party claims arising from your misuse of the service or violation of these Terms, to the extent permitted by law.

Disputes. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any claim not resolved informally will be brought in the state or federal courts located in Delaware, and both parties consent to that jurisdiction, except that either party may bring a qualifying claim in small-claims court.

General. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us about the service.

Governing law: these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
